HEDNO announcement on the application of l. 4759/2020 (GG 245/ Α/09.12.2020) regarding the RES and CHP at Energy Communities

As part of the application of Article 160 of l. 4759/2020 (GG 245/Α/09.12.2020) and relevant clarification circular with ref. no. ΥΠΕΝ/ΔΑΠΕΕΚ/125699/4613/30.12.2020 , HEDNO would like to inform Energy Communities with RES and CHP stations, that the following are from now on in effect:
- As per paragraph 2 of Article 160 “5. any Energy Community Member, which has the purpose of generation of electric energy by Renewable Energy Sources (RES) stations or Combined Heat and Power (CHP) Generation Units (CHP) or Hybrid Stations, and is supported by an Operational Aid Agreement, cannot be a Member of another Energy Community operating in the same Region and having the same purpose and/or main activity, subject to para. 4 of article 2 of l. 4513/2018.
Energy Communities that have been set up for the purpose described in para. 5, shall promptly amend the composition of their members to make sure that they are not members of another Energy Community operating in the same Region and with the same purpose, even if their statute includes a different provision thereof.
- To ensure compliance with the above mentioned legal provisions for pending requests for Final Connection Offers by Energy Communities, HEDNO would like to ask all interested parties, to send to all competent HEDNO authorities within five (5) working days from the date of publication of this announcement (by post to the department of initial folder submissions or by email to one of the email addresses provided at the end of this announcement, depending on the Region to which the station belongs to) the following documents:
Α. In case of compliance of the above criterion:
Solemn Declaration (SD) by the legal representative of the Energy Community, who must confirm that the members of the Energy Community did not participate, during the period between the date of submission to the competent operator of the application for the Final Connection Offer and the date on which the SD was signed, in any pre-existing Energy Community operating in the same Region with the same purpose and/or main activity, namely the generation and sale of electric energy by Renewable Energy Source (RES) stations or Combined Heat and Power (CHP) Generation Units (CHP) or Hybrid Stations.
Β. In case of non compliance of the above criterion:
- The certificate of entry into the General Commercial Registry (GEMI) of the relevant act of amendment of the composition of the members of the Energy Community that confirms that its members do not participate in any pre-existing Energy Community (namely in any Energy Community that has been previously set up by the Energy Community which is reviewed) operating in the same Region with the same purpose and/or main activity, namely the generation and sale of electric energy by Renewable Energy Source (RES) stations or Combined Heat and Power (CHP) Generation Units (CHP) or Hybrid Stations, as well as the relevant act of amendment of the composition of its members, and
- The updated legalization details of the Energy Community (Codified by-laws, General GEMI certificate, GEMI current representation certificate).
- If the Solemn Declaration of Case A is sent within the above-mentioned deadline,
- the Final Connection Offer is provided on the basis of the already determined priority order.
- If the Solemn Declaration of Case B is sent within the above-mentioned deadline, the station “loses” the place held in the priority order and is placed again according to the priority order based on the date of entry into the General Commercial Registry (GEMI) of the act of amendment of the composition of the members of the Energy Community, and the competent Operator shall proceed with reviewing the next applications for receiving a Final Connection Offer as per the determined priority order.
- If the documents of case A or B are not sent, depending on the case, the application shall not be reviewed (its placement in the priority order is withdrawn) and the competent operator continues with reviewing and providing all other applications for Final Connection Offers as per the determined priority order.
- If the Solemn Declaration of Case A is sent after the above-mentioned deadline,
- the request for the Final Connection Offer is reviewed as per the initial priority order and the Final Connection Offer is provided if this is technically feasible.
- If the Solemn Declaration of Case B is sent after the above-mentioned deadline, the station “loses” the place held in the priority order and is placed again according to the priority order based on the date of entry into the General Commercial Registry (GEMI) of the act of amendment of the composition of the members of the Energy Community. If, on the date of submission of the details the competent Operator has proceeded with approving Final Connection Offers to requests next in the priority order, the Final Connection Offer is provided if this is technically feasible.
- If these details are not submitted to the competent Operator within deadline, the placement in the priority order will take place in the immediately next update thereof, namely in the next calendar month as per Ministerial Decision ΥΠΕΝ/ΔΑΠΕΕΚ/123370/4527 (GG Β/5693/23.12.2020), amendment of Ministerial Decision ΥΠΕΝ/ΔΑΠΕΕΚ/28857/1083/7.03.2020.
- For applications for the approval of Final Connection Offers by Energy Communities that have been submitted to the competent Operator after 01.01.21, in order for them to be treated as complete, together with all other documentation they shall include the legal representative Solemn Declaration which shall confirm that the members of the Energy Community do not participate in any other pre-existing Energy Community operating in the same Region with the same purpose and/or main activity, namely the generation and sale of electric energy by Renewable Energy Source (RES) stations or Combined Heat and Power (CHP) Generation Units (CHP) or Hybrid Stations.
